Court to Reexamine Decision That Allowed Trump to Deploy Military Forces to Oregon City
The ninth circuit court has maintained a prohibition on deploying national guard in the Oregon city, following a recent legal decision.
Judicial Panel Agrees to Rehear Case
The federal appeals court decided on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an larger panel of 11 judges. The court also overturned a previous decision from a three-judge panel that had sided with the federal government.
Legal Saga Over Military Presence
This legal directive represents the latest turn in a long-running legal battle over whether the administration has the authority and justification to send state military units in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in due to months of protests.
Conflicting Arguments
The administration has claimed that government employees at the ICE facility in the southern part of the city were under attack, while local authorities assert that municipal police have command of the circumstances.
Contrary to characterizations of the city as a conflict zone, locals have been sharing footage of scenic paths and a vibrant culinary culture, and organizing activities such as an protest bicycle event against the “militarization of our city”.
Recent Legal Actions
The appeals court decision came after a federal judge in Portland enacted two legal injunctions this period – one preventing the federalization of the state troops, and another stopping the use of any military personnel in the state, after attempts to evade the first order by calling up out-of-state forces.
On Monday, the appeals court had temporarily suspended the initial decision – permitting control of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the troops.

The Tuesday decision means the matter will be heard by the full court – with all decisions under review simultaneously – by a group of eleven justices.
“This ruling shows that facts are important and that the courts are striving to ensure government responsibility. The constitution limits the executive authority, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the legal representative in a statement.
“The judicial body is sending a clear message: the executive leader cannot send the military into American urban areas without cause. We will continue protecting state legislation, values, and sovereignty as this case moves forward and our legal battle continues in the judicial system.”
